Robbert Jan van der Weijden

Robbert Jan specialises in complex civil proceedings. He acts as counsel in all sorts of commercial disputes and class actions. Robbert Jan has extensive expertise in, inter alia, matters on director’s liability, securities litigation, and insolvency related affairs. As an attorney, he has represented multinationals in various industries, (international) financial institutions, big four audit firms, claims organisations, bankruptcy trustees and executive directors.

Robbert Jan started his career in the legal profession in the commercial litigation practice of Stibbe. Before that he was a researcher at the highly regarded Radboud Business Law Institute (OO&R) where he obtained a Ph.D degree with a thesis on fraudulent conveyance (“De faillissementspauliana”, published as volume 75 in Serie Onderneming en Recht, Kluwer 2012). Robbert Jan still publishes regularly on various private law and insolvency law topics, and is a much sought-after speaker and lecturer.

Robbert Jan is a deputy judge in the Court of Appeal of Arnhem-Leeuwarden.

  • Defending a group of car dealers in a class action law suit under the Dutch WAMCA (Act on the Resolution of Mass Claims in Collective Action) against claims on behalf of an alleged group of over 200,000 car owners relating to diesel emissions.
  • Representing an energy company in recovery measures for a EUR 500 million claim awarded in arbitration
  • Defending listed financial institutions in disputes with securities holders concerning the disclosure of price-sensitive information
  • Advising an Eastern European food group on additional payment obligations under an SPA amounting to approximately EUR 160 million
  • Litigation for a claims organisation under the Dutch Act on redress of mass damages in collective action (WAMCA) that aims for compensation for agricultural companies that have suffered damages due to large-scale groundwater extraction
  • Summary proceedings for the bankruptcy trustees of Amsterdam Trade Bank against a global tech company in relation to economic sanctions against Russia and penalty payments up to EUR 100 million
  • Litigation for the bankruptcy trustees of a large Dutch retailer in proceedings against the former listed parent company and a bank consortium regarding the avoidance of security rights
  • Mass damages claim for the creditors of an insolvent group of Dutch-Belgian car repair companies against its former financier and former director
