Margriet de Boer

Margriet specialises in complex civil proceedings and arbitration. She has over 20 years of experience in a broad range of complex, multiparty or cross-border disputes. Margriet has advised and assisted companies and national and local authorities in a variety of cases, including contractual disputes, liability matters and class action litigation. Margriet worked in the international litigation and arbitration practice of De Brauw Blackstone Westbroek for almost 15 years, before starting boutique law firm Just Litigation in 2016.

Margriet regularly publishes and lectures in the field of civil procedural law and arbitration law. She authors the yearly chronicle on civil procedural law in the leading Dutch law journal Nederlands Juristenblad, and is a regular contributor to the Dutch journal on civil litigation, Tijdschrift voor Civiele Rechtspleging, for the chronicle on arbitration law. Furthermore, she is editor of a leading commentary on Dutch civil procedural law, Sdu Commentaar Burgerlijk Procesrecht.

Margriet chairs the Advisory Committee for civil procedural law of the Dutch Bar Association (NovA).

Recent work

  • Defending a large tech corporation in a EUR 10 billion GDPR class action law suit under the Dutch regime for collective redress WAMCA (Act on the Resolution of Mass Claims in Collective Action)
  • Defending a group of car dealers in a class action law suit under the Dutch WAMCA against claims on behalf of an alleged group of over 200,000 car owners relating to diesel emissions
  • Representation of one of the applicants in the proceedings under the Dutch WCAM (Act on the Collective Settlement of Mass Claims) for the binding declaration of the EUR 1.3 billion settlement reached between Ageas (formerly Fortis) and commercial and non-profit claimant organisations acting on behalf of Fortis shareholders
  • Representation in first instance and on appeal of a real estate company in proceedings resulting from a prejudgment attachment, concerning questions of attachment and enforcement law, and statute of limitation
  • Arbitration (NAI) regarding an EPC contract for a pilot plant for the production of chemicals
  • Summary proceedings for a shareholder/investor in retail chain Marqt about a drag-along right under a shareholders’ agreement
  • Mediation regarding a dispute over the termination of an IT contract
  • Representation of companies, government authorities and witnesses in witness examinations and other procedures to gather evidence, including witness examinations at the request of a foreign court under the Hague Evidence Convention (letters of request), witnesses invoking legal privilege and motions for the production of documents under Section 843a of the Dutch Code of Civil Procedure
